Terms of Service for kakak.ai

Please read these Terms of Service (the "Terms") carefully because they govern your use of the kakak.ai services, our website located at https://kakak.ai (the "Site"), and any content generated by kakak.ai based on your User Content (defined below) ("Generated Content"). The Site, our services, and the Generated Content are collectively called the "Services".


1. Agreement to Terms


By using our Services, you agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not use the Services. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.


2. Privacy Notice


Please review our Privacy Notice, which also governs your use of the Services, for information on how we collect, use and share your information.


3. Changes to these Terms or the Services


We may update the Terms at our sole discretion. If we do, we’ll notify you by posting the updated Terms on the Site or through other communications. It’s important that you review the Terms whenever we update them or you use the Services. If you continue to use the Services after we have posted updated Terms, it means that you accept and agree to the changes. If you don’t agree to be bound by the changes, you may not use the Services anymore. Because our Services evolve over time, we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.


4. Who May Use the Services?


Age Requirements and Parental Consent


Minimum Age: You must be at least 16 years old to create an account.


Under Age 16: We do not knowingly collect data from children under 16. If we discover we have collected such data, we will delete it within 48 hours.


Parents' Rights: Parents/guardians of minors can request access to, modification of, or deletion of their child's data by contacting halo@kakak.ai with proof of guardianship.


Account Requirements


You may use the Services only if you are capable of forming a binding contract with kakak.ai, and not otherwise barred from using the Services under applicable law.


To use the Services, you will need an account. It is important that you provide us with accurate, complete, and current account information and keep this information up to date. If you don't, we might have to suspend or terminate your account. To protect your account, keep the account details and password confidential, and notify us right away of any unauthorized use. You are responsible for all activities that occur under your account.


5. Feedback


We appreciate feedback, comments, ideas, proposals, and suggestions for improvements to the Services ("Feedback"). If you choose to submit Feedback, you agree that we are free to use it without any restriction or compensation to you.


6. Subscriptions


kakak.ai requires a subscription fee for the use of certain features of our Services. Upon purchasing a subscription, you authorize us, or our third-party payment processor, to charge the subscription fee. We may require additional information like your credit card details and contact information for billing purposes.


General Subscription Information


Your Subscription authorizes us to share your payment information with third parties to complete the transaction. Payments for plans and top-ups are generally non-refundable and non-transferable, except as set out in the Payment and Refund Policy below. The fees and applicable taxes are payable in Indonesian Rupiah (IDR).


One-Time Purchases


Gold and Platinum plans — whether for a 30-day or 1-year validity period — and all Pro Credit top-ups are one-time purchases. There is no automatic billing and no automatic renewal. Your access runs until the plan's validity period ends, after which your account returns to the free plan. Because there is no recurring subscription, there is nothing to cancel.


Recurring Subscriptions via XLSmart


The exception to the above is a bundle purchased through XLSmart. Such bundles are recurring subscriptions and renew automatically until you stop them.


  • Renewal Reminders: sent directly by XLSmart via SMS to your registered number. kakak.ai does not send renewal reminders by email.
  • How to Stop: go to Settings > Subscription, then select "Manage".
  • Stopping takes effect from the next billing period. A renewal that has already been processed is not reversed and is not refunded, except as provided in the Refund Policy below.

    • Price Changes


    We may change prices with 60 days' notice. Price changes apply to subsequent purchases and do not affect a plan that is already active. For recurring subscriptions through XLSmart, a new price applies from the next renewal period, and you may stop the subscription before that period if you do not accept the new price.


    Payment and Refund Policy


    General Rule: plan and top-up fees are generally non-refundable. The exceptions are set out below, in line with the rights of Indonesian consumers under UU No. 8/1999 (Consumer Protection Law).


    Indonesian Consumer Rights


  • Service Failure Refunds: If our service is unavailable for more than 72 consecutive hours due to our fault, you may request a pro-rated refund.
  • Cooling-Off Period: Indonesian consumers may cancel within 7 days of initial purchase for a full refund if they have not actively used the service beyond the free trial.
  • Technical Issues: If you experience persistent technical issues preventing service use, contact halo@kakak.ai for resolution or refund consideration.
  • Service Discontinuation by kakak.ai: If we discontinue the Services, annual plan purchasers receive a pro-rated refund. See the Termination section.

    • To request a refund under these consumer protection provisions, contact halo@kakak.ai with your account details and reason for the request. Refund requests will be processed within 14 business days.


    Stopping a Subscription


    For plans bought as a one-time purchase, there is no recurring subscription to cancel. Your access continues until the plan's validity period ends, after which your account returns to the free plan on its own.


    For bundles subscribed through XLSmart, you may stop the subscription at any time via Settings > Subscription > "Manage". Stopping takes effect from the next billing period; your access remains active until the end of the period already paid for, and no refund is issued for that period except as provided in the Refund Policy above.


    Free Account


    kakak.ai provides a free account service with usage limits determined by kakak.ai. Once these usage limits are reached, you can continue to use the service by subscribing to our subcription plan.


    7. Your Content


    Under this section, we describe the guidelines related to any text, files, images, graphics, or other types of content that you share or store through kakak.ai (referred to as "User Content").


    7.1 Posting Content


    kakak.ai doesn't claim any ownership rights in any User Content. Any rights you may have in your User Content are not restricted by these Terms.


    7.2 How We Use Your User Content


    By making any User Content available through the Services, you grant kakak.ai a limited, non-exclusive license to use, host, store, and process your User Content in the following ways:


    a) Service Delivery: Your content is processed to generate AI responses and provide our services to you.


    b) RAG Processing (Document Embeddings): Documents you upload are converted into vector embeddings and stored in our database to enable semantic search and contextual AI responses. This is NOT the same as training AI models. Your content remains associated with your account and is not used to improve the underlying AI models (GPT, Gemini, Claude, etc.).


    c) Third-Party AI Processing: Your prompts and uploaded documents are sent to third-party AI providers (Google, OpenAI, Anthropic, Perplexity, Deepseek, and others) to generate responses. We use their APIs in zero-data-retention mode where commercially available, meaning they do not use your content for their own model training purposes.


    d) Aggregated Analytics: We may use de-identified, aggregated statistics about service usage for our own analytics and service improvement (e.g., "users asked 1000 questions about topic X"), but these statistics cannot be traced back to you individually.


    e) Content Review: We may review content to investigate Terms violations, security threats, or in response to legal requirements.


    What We Do NOT Do:

  • We do NOT use your content to train our own AI models
  • We do NOT share your content with AI providers for their model training purposes
  • We do NOT use your content for marketing or advertising
  • We do NOT sell your content to third parties

    • 7.3 Your Responsibility for User Content


    You are solely responsible for all your User Content. You assert that you have all rights necessary to grant us the license rights in your User Content under these Terms. You also assert that your User Content, its use and provision through the Services, and any use by kakak.ai will not infringe or violate any third party's intellectual property rights, privacy rights, or any applicable law or regulation.


    7.4 Removal of User Content


    You can remove your User Content by specifically deleting it. However, some of your User Content may not be completely removed and copies of your User Content may continue to exist on the Services. We are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your User Content.


    7.5 Your Use of Generated Content


    Subject to your compliance with these Terms, kakak.ai grants you a non-exclusive, worldwide, license to use, copy, modify, distribute, publicly display, and publicly perform Generated Content for your lawful business purposes.


    7.6 Ownership of Intellectual Property


    We may make available through the Services content that is subject to intellectual property rights, including Generated Content. We and our licensors retain all rights to that content.


    8. Usage Requirements, General Prohibitions, and kakak.ai’s Enforcement Rights


    This section sets forth your agreement on the use of the Services.


    8.1 You agree that you will use the Services:


  • Only in a lawful manner and in compliance with all applicable laws;
  • In accordance with the Terms, the license granted in Section 7, and any documentation, usage guidelines, parameters, and other requirements provided to you by us or its licensors, as may be modified by us or its licensors from time to time;
  • In a manner that does not infringe, misappropriate, or otherwise violate any of our or its licensors' rights or those of any other person or entity;
  • As it relates to Generated Content, in a manner that is consistent with the usage policies of the AI model provider used to generate it

    • 8.2 You agree not to do any of the following:


  • Use, display, mirror or frame the Services, any individual element within the Services, the layout and design of any portion of the Services, or our trademarks, service marks, logos or other proprietary information, without our express written consent;
  • Access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers;
  • Attempt to probe, scan, or test the vulnerability of any our system or network or breach any security or authentication measures;
  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by us or any of our providers or any other third party (including another user) to protect the Services;
  • Attempt to access or search the Services or download content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by us or other generally available third-party web browsers;
  • Use any meta tags or other hidden text or metadata utilizing our trademark, logo, URL, or product name without our express written consent;
  • Use the Services for any commercial purpose or for the benefit of any third party, except as expressly permitted by these Terms;
  • Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services;
  • Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
  • Post any content on the Services that is hate speech, threatening, sexually explicit or pornographic; incites violence; or contains nudity or graphic or gratuitous violence;
  • Violate any applicable law or regulation;
  • Encourage or enable any other individual to do any of the foregoing.

    • 8.3 Our Enforcement Rights.


    We are not obligated to monitor access to or use of the Services or to review or edit any content. However, we have the right to do so for the purpose of operating the Services, to ensure compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. We reserve the right, at any time and without prior notice, to remove or disable access to any content, that we consider, in our sole discretion, to be in violation of these Terms or otherwise harmful to the Services.


    9. Copyright Policy


    kakak.ai respects copyright law and expects its users to do the same. It is kakak.ai’s policy to terminate, in appropriate circumstances, account holders who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.


    10. AI Service Limitations and User Responsibilities


    Nature of AI-Generated Content


  • Accuracy: AI responses may contain factual errors, outdated information, or "hallucinations" (plausible-sounding but false information). Always verify important information independently.
  • Not Professional Advice: Generated content does not constitute legal, medical, financial, or professional advice. Consult qualified professionals for critical decisions.
  • Bias: AI models may reflect biases present in training data. We do not guarantee neutral or unbiased outputs.
  • Copyright Uncertainty: We cannot guarantee that generated content does not infringe third-party intellectual property rights. You are responsible for verifying originality.
  • No Content Verification: We do not fact-check AI-generated content before displaying it to you.

    • User Responsibilities


  • Verify important information independently
  • Do not use the service for high-risk decisions without human oversight
  • Review and comply with our Acceptable Use Policy (Section 8)
  • Understand that AI models are operated by third parties (Google, OpenAI, etc.) and we have limited control over their outputs

    • Model Changes


    AI providers may update their models at any time, which may affect output quality, style, or capabilities. We will notify users of major model changes where feasible.


    11. Links to Third Party Websites or Resources


    The Services may allow you to access third-party websites or other resources. We provide access only as a convenience and are not responsible for the content, products, or services on or available from those resources or links displayed on such websites. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party resources.


    12. Termination


    12.1 Termination by kakak.ai


    We may suspend or terminate your account under the following circumstances:


    Immediate Termination (No Notice):

  • Violation of laws (illegal content, fraud, etc.)
  • Threats to security or integrity of our Services
  • Violations of usage prohibitions in Section 8.2
  • Non-payment of subscription fees after 30-day grace period

    • Termination with Notice:

  • Service discontinuation: 60 days' notice; pro-rated refunds for annual subscribers
  • Terms violations (non-critical): 14 days' notice and opportunity to remedy
  • Business decisions: 30 days' notice for paid accounts

    • Data Export Upon Termination:

    Upon termination, you will have 30 days to export your data (chats, uploaded documents) before permanent deletion. We will provide data export tools in your account settings.


    Surviving Terms: Upon any termination, discontinuation or cancellation of Services, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.


    12.2 Termination by You


    You may cancel your Account at any time by sending an email to us at halo@kakak.ai or through your account settings. Upon cancellation, you will have 30 days to export your data before it is permanently deleted.


    13. Warranty Disclaimers


    The services and content are provided "AS IS," without warranty of any kind.


    Without limiting the foregoing, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content.


    AI Service Disclaimer: You acknowledge that AI-generated content may contain inaccuracies, and you are responsible for verifying any information before relying on it for critical decisions.


    14. Limitation of Liability


    General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, kakak.ai's total liability for any claims arising from these Terms or your use of the Services shall not exceed:

  • For paid subscribers: the amount you paid us in the 12 months before the claim arose
  • For free users: IDR 1,000,000 (one million Rupiah)

    • Excluded Damages: We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including:

  • Lost profits or revenue
  • Loss of data (except where caused by our willful misconduct)
  • Business interruption
  • Loss of goodwill

    • Exceptions to Limitation: These limitations DO NOT apply to:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct by kakak.ai
  • Any liability that cannot be excluded under Indonesian law

    • Indonesian Consumer Rights: This section does not limit your statutory rights under UU No. 8/1999 (Consumer Protection Law), including rights to compensation for defective services.


    EU Consumer Rights: For EU users, this section does not affect your statutory consumer rights under EU Directive 93/13/EEC and applicable national consumer protection laws.


    15. Dispute Resolution


    15.1 Governing Law


    These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.


    For users located in the European Economic Area (EEA), United Kingdom, or Switzerland, this section does not affect your statutory consumer rights under local law.


    15.2 Dispute Resolution Process


    Indonesian Users: Any disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the District Court of South Jakarta, Indonesia.


    International Users: Disputes shall be resolved through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to the courts of your local jurisdiction or as otherwise agreed by the parties.


    15.3 Arbitration Notice


    The mandatory arbitration clause mentioned in the introduction to these Terms does not apply to users in jurisdictions where such clauses are prohibited by consumer protection law, including:

  • Indonesia (per UU No. 8/1999 - Consumer Protection Law)
  • European Union (per Directive 93/13/EEC)
  • Other jurisdictions with similar consumer protection provisions

    • For users in these jurisdictions, Section 15.2 applies instead.


    15.4 Class Action Waiver


    To the extent permitted by law, all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class action or representative proceeding. This waiver does not apply where prohibited by law.


    16. General Terms


    16.1 Entire Agreement


    These Terms constitute the entire and exclusive understanding and agreement between us and you regarding the Services and Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between us and you regarding the Services and Content.


    16.2 Severability


    If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.


    16.3 Assignment


    You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.


    16.4 Notices


    Any notices or other communications provided by us under these Terms, including those regarding modifications to these Terms, will be given by us: (i) via email; or (ii) by posting to the Services. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.


    16.5 Waiver


    Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of kakak.ai. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
